The Child’s Best Interests

As with most areas in family law involving minors, such as child support and custody, the decisions made regarding visitation are to be made in accordance with the child’s best interests. According to the Chicago Bar Association, it is reasonable for judges to rule that the child’s best interests involve continuing a relationship with both parents. Your child should know he or she has two parents who care about him or her, not just one.

Determining Visitation

In a “reasonable visitation”, you and your spouse use collaboration and mediation methods to try and work out the specifics of visitation rights. Realistically, this usually means that the parent with custodial authority has more power over visitation times and scheduling. If you feel like your spouse is abusing that authority in the future, you can bring it to the attention of the judge at a later time.

In a fixed visitation schedule, the judge presiding the case chooses the times (and potentially the place) that the visitation will take place. The judge may decide to do this if it becomes clear that the parents are unable to work reasonably together to make decisions.
